    What is a Will?

A Will or Last Will and Testament,  is a legal document that allows you (Testator) to control who (Beneficiary) gets what when you die. The person who creates the will is called the Testator or Testatrix, and the people or entities who receive the property or assets are called Beneficiaries.  A will can be as specific or broad as you desire.  Notarial wills must be typed and executed in front of a notary and two witnesses.  There are numerous legal requirements that wills must abide by in order to be binding, and so the lawyers at Schoenfeld Law Firm are here to assist.

    Do I Need a Will?

Ever wonder what happens to all of your property when you pass away? Are you concerned that your most prized possessions may get into the hands of the wrong person, upon your death? A last will and testament prevents this from happening. Once you have a will, you no longer have to question who will inherit your belongings. A will gives you a voice beyond the grave. It allows you to be in control and express who will inherit your entire estate, when you are no longer around.

When Should I Get a Will?

Not having a will in place when you die can be risky.  This is called dying Intestate. Without a will, Louisiana law dictates who gets your property, and so your assets may end up with the wrong people.  A will protects your family if something happens to you by allowing you to control how your assets will be distributed when you pass away.

For a will to be valid, the Testator must be in the right state of mind and must understand what they are signing.  Frequently, people do not even consider getting a will created for a loved one until they are too sick, unable to make their own decisions, or can no longer understand what they are signing. If this happens, a notary may not be able to notarize the will.

NOW is the best time to prepare. Do not wait until it is too late.  A last will and testament is like an insurance policy.  It’s a gameplan for what happens to your estate once you are deceased. Although it is something you won’t personally benefit from in your lifetime, your family and heirs will thank you for it. Your family and heirs will be happy you have a will in place because they will not have to question what your wishes are. Plus, it will give you peace of mind knowing that you have properly prepared for your family’s future, even though you are no longer with them.

A will benefits everyone:  it makes life a little less stressful for your loved ones because they will know what your wishes are, and it will give you comfort knowing that your assets will end up with the right people upon your death.
